The rules in Scotland

Scotland has its own planning system and its own property law. The Prescription Act 1832 does not extend to Scotland, so the English rules on rights to light do not apply there. Councils may still refer to the BRE guidance. Take local legal advice.

Getting signed off in Scotland

In Scotland, you need a building warrant from the council before work starts, and design evidence such as SAP and overheating assessments goes in with the application. At the end you submit a completion certificate with your test reports. The council then has 14 days to accept it, and you can’t move into a new building until it does, unless the council allows temporary occupation.
